How Will The New Entry Type 86 Requirements Impact Cargo Filings?

On April 13, 2024, U.S. Customs and Border Protection will be implementing an update to the Automated Commercial Environment (ACE) that requires all Entry Type 86 transactions to be filed prior to or upon the arrival of cargo. Any late filings will result in rejection and the cargo being held until a different and appropriate entry is made. This update also applies to goods subject to Partner Government Agency requirements. On January 16, 2024, CBP published an update to the ACE Entry Type 86 test, modifying the filing deadline from within 15 days of arrival to upon or prior to arrival. This change is aimed at expediting the process and supersedes previous notices. More information can be found in the Federal Register Notice (FRN) and questions can be directed to CBP via email.
